NYC Soda Ban Defeated Again; City To Appeal

A New York State appeals court has upheld an earlier ruling by the New York Supreme Court that struck down New York City's attempted ban on sugary beverages 16 ounces or larger.

The First Department of the state Supreme Court's Appellate Division concurred with the Supreme Court that the city's board of health had overstepped its authority with the ban, violating the state principle of separation of powers.

The city's corporate councsel issued a statement saying that the city will appeal the decision to the state's highest court, the Court of Appeals.
