California Judge Rejects False Ad Claim Against ValueClick, Primary Ads

In a ruling that could blunt one of the most aggressive state laws regulating commercial email, Los Angeles Superior Court Judge Richard Adler Monday granted a summary judgment favor of ValueClick and co-defendant Primary Ads in a $45 million false advertising suit brought last year by Internet service provider Hypertouch, reports Reuters. Adler ruled that Hypertouch's claim that its customers were inundated with 45,000 emails were covered by the federal CAN-SPAM Act, but did not demonstrate any actual fraud or deceptive claims by the defendants.
