Court Okays FCC Radio Station Limits, Includs Ad Sales Agreements

The U.S. Court of Appeals for the Third Circuit Friday granted the FCC a request to limit the number of radio stations owned by a single broadcaster can own in a market. Significantly, the court upheld the commission's view that joint advertising sales agreements between radio station owners count as part of the new ownership rules. According to the new rules, in markets where there are at least 45 stations, a company can own up to eight radio stations but a maximum of five may be in the same band, AM and FM. In markets with 14 or fewer stations, an entity can own up to five stations with no more than three in the same band.
