A story in the February 24 edition of Email Marketing Daily, while not factually incorrect, can be clarified regarding a judicial opinion in a case involving 250ok and SparkPost. In ruling in SparkPost's favor on a claim of unjust enrichment, Vice Chancellor Joseph R. Slights III of the Delaware Court of Chancery based his history of the case on a complaint filed by 250ok, but did not issue an opinion on alleged misappropriation of trade secrets, a matter that still must be litigated.
