Allison Fitzpatrick represents advertisers, media companies, and agencies in connection with all aspects of advertising, marketing, and promotions.

Ms. Fitzpatrick frequently counsels clients on new media issues, including with respect to social media, user-generated content, blogging, mobile marketing, digital and other emerging media. She develops clients’ blogging and social media policies and procedures and reviews clients’ social media campaigns to ensure compliance with the Federal Trade Commission’s Endorsement Guides, .com Disclosure Guides and Native Advertising Guidelines. She also develops and negotiates influencer agreements and works with clients on all aspects of their influencer campaigns, including reviewing influencer content, developing social media and disclosure policies, and creating and negotiating influencer contracts. In addition, Ms.
Fitzpatrick has significant experience in the area of sweepstakes, skill contests, free offers, premiums, rebates, coupons and loyalty/rewards programs and other promotions, including on Facebook, Twitter, Pinterest, Instagram, Snapchat, Twitch, Foursquare and YouTube. In addition to social media promotions, she continues to work on more traditional promotions, including online, mobile, on-pack, golden ticket, and direct mail promotions. She regularly counsels clients on all aspects of promotions, including with respect to drafting and reviewing their rules, bonding and registering the promotion (if applicable), preparing winner affidavits/declarations and developing and negotiating prize supplier and promotional agreements.

In early September, the Federal Trade Commission updated its Endorsement Guides for truth-in-advertising, specifically targeting influencer marketing via social media.
