Autovermietung GmbH, from the Regional Court of Duesseldorf, Germany. Last week Hertz was granted an initial injunction against Claria with respect to its display of advertisements. The German court
issued this injunction through an ex parte process, by which injunctions can be granted solely based upon one side's arguments. Claria was given no opportunity to be heard by the German court. Because
Hertz made public statements concerning the ruling, which is prohibited under German law, Claria utilized the ex parte process to prevent Hertz from making such public statements.
