Perhaps the real story concerns providing subscribers explicit rights to "opt out" of Comcast's public network upfront whenever the appropriate equipment is installed. As such is this an FCC issue?
A few reasons: speed degradation - "shouldn't be affected" - humbug!; privacy of associated homeowners "secure" WiFi - easier to hack; Comcast's rights to use homeowners equipment (technically "owned" via the monthly lease); not being informed upfront that Comcast is using the Homeowners equipment without permission and without compensation.
