A federal appellate court Friday sided with MySpace and dismissed a lawsuit brought by the parents of a teen girl who was assaulted by someone she met and communicated with via the social networking
site.
The 5th Circuit held that the federal Communications Decency Act immunizes MySpace from a lawsuit based on content posted by users of the site.
"Parties complaining that
they were harmed by a Web site's publication of user-generated content have recourse; they may sue the third-party user who generated the content, but not the interactive computer service that enabled
them to publish the content online," the court wrote.
