Cephalon Gets Provigil, Nuvigil Subpoena

The U.S. Department of Justice is investigating the marketing of Cephalon's sleep disorder drugs Provigil and Nuvigil.

The Frazer, Pa., company said the subpoena relates to "certain promotional practices." The company said it is responding to the subpoena and will cooperate fully with the investigation. The company reported $481 million in U.S. sales of Provigil in the first six months of 2011, while sales of Nuvigil were $110.6 million. Worldwide sales of Provigil totaled $1.12 billion in 2010, while sales of Nuvigil, which is only on the market in the U.S., totaled $186.2 million.
