Aereo Cleared By Appeals Court

 

Aereo's online video service can continue to operate, the 2nd Circuit Court of Appeals ruled this morning.

A coalition of TV networks challenged the Barry Diller-backed service, which allows paying subscribers to watch free over-the-air TV shows on demand, on devices like iPhones and iPads. The networks argued that this service infringed their right to publicly perform the programs -- which is one of the rights held by copyright owners.

But a three-judge panel of the 2nd Circuit ruled today that Aereo's transmissions are not a public performance. The panel upheld a trial judge's refusal to issue an injunction shuttering the service.

One judge dissented from the holding.
