In a lawsuit filed Friday in U.S. District Court in White Plains, N.Y., Great Atlantic &
Pacific Tea Co. charges that Stop & Shop is lying to consumers about having lower prices than A&P. It claims that Stop & Shop's circulars, in-store ads and Internet ads use false or
misleading information to arrive at figures claiming savings of 9 to 19% over A&P.
A&P says both it and consumers are harmed by the reputedly false ads. Stop &
Shop's ads say the cost savings come from regularly priced items. But A&P charges that Stop & Shop admits in fine print that it applied discounts to the items before comparing them to
A&P. A spokesman for Stop & Shop declined to comment, citing the continuing litigation, as did an A&P spokeswoman.
