Intelligence officials think that the US government's secret scanning of Yahoo's customer emails should not be considered unconstitutional, according to legal documents filed in a closed court hearing in the secret Foreign Intelligence Surveillance Court (FISC). These intelligence officials hope to change how the U.S. Constitution's Fourth Amendment, which protects against unreasonable searches and seizures, has been interpreted for many years.

Their argument is that allowing technology to scan emails to detect terrorist behavior does not violate privacy because it is not seen by human eyes unless the email is flagged. The officials compared the scanning technology to existing tools that scan for spam emails.
