People, no doubt, will pay close attention to the alleged political discrimination lawsuit filed in connection with the termination of James Damore and
David Gudeman, two ex-employees and lead plaintiffs in a class action brought in a California state court. Lloyd Green writes that the Damore case raises questions about
the integrity of its leadership team, and whether the "high-minded rhetoric and self-image are simply illusory." What makes the case even more interesting are California
laws. Under California law, political speech appears to be protected from retaliation -- even in the private sector, Green writes. Unlike the First Amendment that guarantees speech
rights in the face of government retribution, California appears to extend speech protections to
private sector
employees.
