Just An Online Minute... Google Wins Another Legal Battle

Continuing its winning streak in AdWords lawsuits, Google has obtained a favorable settlement in a trademark infringement case brought four years ago by American Blind and Wallpaper Factory.

The agreement, filed Friday, provides that American Blind will withdraw its lawsuit and won't bring any other similar cases against Google.

In the original lawsuit, American Blind argued that Google's policy of allowing rivals to appear as sponsored search results when users queried on the American Blind brand name violated its trademark rights.

American Blind isn't the only company to have made that argument, nor is it the only company to see it go nowhere in court. Insurance company Geico also unsuccessfully sued Google for trademark infringement based on its AdWords program. In that case, federal district court judge dismissed the key charge after a trial, finding that Geico hadn't proven that consumers were confused when they queried on the name "Geico" and ads for rivals appeared as paid search results. Google also won a similar lawsuit brought in federal court by Rescuecom, a computer repair and consulting business.

Still, this string of victories isn't dissuading everyone from filing lawsuits. Just last month, American Airlines became the most recent company to sue Google for trademark infringement based on its AdWords policy.
