Lawsuit Between Email on Acid And 250ok Finally Settled

The long, bitter legal dispute between Email on Acid and 250ok, Inc. over a tool that allows users to see how their emails will be rendered has finally been resolved.  

An order dismissing the case was signed July 6 by U.S. Judge Regina M. Rodriguez, of the U.S. District Court for the District of Colorado, following an apparent settlement. 

Validity Inc., which now owns 250ok, Inc., paid $1.6 million on May 16, according to documents on file with the court.  

The settlement was delayed several times due to last-minute tweaking.

Validity, while acknowledging the case has been dismissed and settled, said it does not comment on litigation.

Filed in 2019, the lawsuit concerns Email On Acid’s software-as-a-service that allows users to preview how emails will render in Gmail, Yahoo and other email platforms, and via mobile, desktop and the web.  

Email On Acid alleged that after “licensing its technology and agreeing not to create a competing product, 250ok abused this access to create its own rip-off version of the product, marketed itself as a competitor to Email on Acid, and has attempted to poach Email on Acid’s customers.”

Validity acquired 250ok in 2020 and Pathwire purchased Email on Acid in 2021, and was itself bought by Sinch a few months later.  

The only similar product on the market apparently is offered by Litmus.
